Welcome to AlignMe, a posture improvement application owned and operated by Paced Studios LLC, a California limited liability company ("Paced Studios," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the AlignMe app, website, associated services, and any products or digital content provided through our Shopify store (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not access or use our Services.

1. Eligibility

You must be at least 13 years old to use the AlignMe app. If you are under 18, you represent that you have obtained parental or legal guardian consent.

2. Not Medical Advice

AlignMe is an AI-powered application intended for educational and informational purposes only. The app offers posture assessments, exercise suggestions, and wellness content based on user inputs and AI-generated analysis. It does not diagnose, treat, cure, or prevent any disease or medical condition.

None of the content or services provided by AlignMe constitutes medical advice. The app's suggestions are estimates generated by algorithms that may be incomplete or inaccurate. Always consult with a qualified healthcare professional before beginning any posture, exercise, or wellness program.

Paced Studios LLC disclaims all liability arising from reliance on any information provided through the app.

3. User Responsibilities

By using AlignMe, you agree to:

  • Provide accurate and truthful information.

  • Use the app in a safe and responsible manner.

  • Refrain from using the app to self-diagnose or delay seeking professional medical attention.

  • Follow all safety instructions and listen to your body. If you feel pain, dizziness, or discomfort, stop using the app and consult a professional.

4. Account Security

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities that occur under your account.

5. Intellectual Property

All content provided through AlignMe, including but not limited to logos, design, text, images, videos, graphics, and software, is the property of Paced Studios LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written permission.

6. Prohibited Uses

You agree not to:

  • Use the app for any unlawful purpose;

  • Reverse engineer, decompile, or disassemble the app;

  • Interfere with or disrupt the servers or networks used to provide the Services;

  • Use automated scripts to collect information or interact with the Services;

  • Impersonate any person or entity.

7. AI Accuracy Disclaimer

AlignMe uses artificial intelligence (AI) to provide posture analysis and recommendations. AI systems are not perfect and may produce incorrect, outdated, or misleading outputs.

We do not guarantee the accuracy, completeness, or usefulness of any information provided. Use your judgment, and consult with professionals when needed.

8. Limitation of Liability

To the fullest extent permitted by law, Paced Studios LLC and its officers, directors, employees, contractors, affiliates, or agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages;

  • Any loss of profits, revenue, or data;

  • Any bodily injury or health outcomes resulting from use or misuse of the app;

  • Any damages caused by reliance on AI-generated outputs or content.

You use the Services at your own risk.

9. Indemnification

You agree to defend, indemnify, and hold harmless Paced Studios LLC, its affiliates, officers, directors, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses (including attorney fees) arising out of or related to your use or misuse of the Services, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.

10. Termination

We reserve the right to suspend or terminate your access to the Services at any time and without notice if we believe you have violated these Terms.

11. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you through the app or via email. Your continued use of the Services after such notice constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws rules.

Any legal action or proceeding arising out of your use of the Services shall be brought exclusively in the state or federal courts located in California, USA.

14. Shopify Store Disclaimer

Our Shopify store offers digital and physical products intended to support your posture and wellness journey. All product claims, health benefits, and results are for informational purposes only and are not evaluated by the Food and Drug Administration (FDA).

Paced Studios LLC makes no guarantees about the efficacy or outcomes of any product sold. Always read labels, instructions, and consult with a healthcare provider before using any product.

We are not responsible for any injury, loss, or damage caused by the use or misuse of products sold on our Shopify store.

By purchasing from our store, you agree to these disclaimers and assume all associated risks.

15. Data Protection and GDPR Compliance

Our data collection and use practices comply with the General Data Protection Regulation (GDPR), UK GDPR, and California Consumer Privacy Act (CCPA). For more details on how we handle personal data and your rights under applicable law, please refer to our Privacy Policy.

16. HIPAA Disclaimer

AlignMe is not a HIPAA-covered entity or business associate. The app is not intended to store or process Protected Health Information (PHI). Do not submit PHI through the app or associated services.

17. Subscription Terms

AlignMe offers subscription plans that are billed annually. Subscriptions are available on iOS, Android, and other supported platforms. By subscribing, you authorize Paced Studios LLC and/or the respective app store (Apple App Store or Google Play Store) to automatically charge the applicable subscription fees to your provided payment method on a recurring yearly basis until you cancel.

If you subscribe through the Apple App Store or Google Play Store, your subscription and billing are managed by those platforms. To cancel or manage your subscription, you must do so through your respective account settings in the Apple App Store or Google Play Store. Deleting the app does not cancel your subscription.

All fees are non-refundable unless otherwise required by law. We reserve the right to change subscription pricing with reasonable advance notice provided via email, through the app, or via app store notifications.

18. Experimental & Beta Features

From time to time, AlignMe may introduce experimental or beta features for testing and feedback purposes. These features are provided "as is" with no guarantees of performance or reliability and may be modified or discontinued at any time.

19. Affiliate Disclosure

AlignMe may include links to third-party products or services, including affiliate links. We may earn a commission if you click through and make a purchase. These commissions help support the development and maintenance of the app.

20. Dispute Resolution and Arbitration

By using AlignMe, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding individual arbitration. You waive any right to participate in class action lawsuits or class-wide arbitration.

This arbitration agreement shall be governed by the Federal Arbitration Act and applies to all claims regardless of legal theory. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

21. Entire Agreement

These Terms constitute the entire agreement between you and Paced Studios LLC and supersede any prior agreements related to the Services.
